CM Kejriwal will not be able to sign files even after bail? Abhishek Singhvi told the truth

Arvind Kejriwal Bail Conditions: Delhi Chief Minister Arvind Kejriwal got bail on Friday (August 13, 2024) in the CBI case related to Delhi liquor policy, after which Delhi CM’s lawyer Abhishek Manu Singhvi clarified that misinformation is being spread that Arvind Kejriwal cannot sign any file while out on bail. Stating the fact, he said, “The Supreme Court has not made any change in the previous order passed on July 12 in the Prevention of Money Laundering Act (PMLA) case.” This reaction of Abhishek Manu Singhvi came a few hours after the Supreme Court granted bail to Arvind Kejriwal in the Delhi liquor policy case.

Delhi CM’s lawyer told English news channel ‘India Today’, “It is being spread that Arvind Kejriwal cannot sign any file. You can sign all the files except those related to the liquor policy case under which he was arrested.”

“No new conditions imposed on Arvind Kejriwal”

Abhishek Manu Singhvi also clarified that the Supreme Court order said that Arvind Kejriwal does not have any department. He said, “No new condition has been imposed on the Delhi CM. It is baseless to say that he cannot work as Chief Minister. The conditions you have mentioned were there for many months in the ED case, not a single new condition has been imposed. He is entitled to deal with and sign all files except those related to this case.”

Abhishek Manu Singhvi further said, “This distinction was made in the Supreme Court order of July 12, which said that Arvind Kejriwal can sign all the files that have to go to the Lieutenant Governor. The files that are with other people are signed by his ministers. It is political to say that he cannot work. All I will say is that an elected Chief Minister should not be removed by adopting such tactics.”

There will be no political crisis if Delhi CM is out!

According to the senior advocate, “Since Arvind Kejriwal is out of jail, there will be no governance crisis in Delhi. Now that he is out of jail, his ministers are signing files and he can also sign files for the Lieutenant Governor, I don’t think governance is an issue.”

Which two conditions did the SC bench uphold?

In fact, while granting bail to Delhi CM Arvind Kejriwal, a bench of Justice Suryakant and Justice Ujjwal Bhuiyan retained only two bail conditions that he will be present before the lower court on every date of hearing unless he is exempted and will fully cooperate in the speedy completion of the trial. It decided to remove the conditions that the Chief Minister cannot go to the Delhi Secretariat or sign files. However, relief cannot be applied in this case, as a bench led by Justice Sanjeev Khanna had earlier imposed certain conditions on May 10 and July 12, 2024. It was clarified that any change or withdrawal of these conditions can be done only by a larger constitution bench.

• Arvind Kejriwal will not be allowed to enter the Chief Minister’s Office and Delhi Secretariat
• He will not “sign official files unless it is necessary to do so for the approval of the Lieutenant Governor of Delhi”
• He would not comment on his role in the liquor policy matter
• He will not interact with any witnesses in the case nor will he have access to official case files.
