Shock to AAP leader Somnath Bharti from Supreme Court, case will be conducted in UP only on this controversial statement.

Supreme Court: Aam Aadmi Party leader Somnath Bharti will have to face trial in Sultanpur, UP. The Supreme Court has rejected the demand to transfer the case against him to Delhi. Besides, the court has also lifted the stay on the case. This case was registered in 2021 regarding Somnath’s derogatory statement about the hospitals of UP and the people there.

On January 10, 2021, Somnath Bharti had reportedly said in Amethi that children are being born in the hospitals of UP, but puppies are being born to dogs. Regarding this, a person named Somnath Sahu, resident there, had lodged an FIR against him in Jagdishpur police station under sections 505 and 153A of IPC.

Notice was issued to UP government

Somnath Bharti had reached the Supreme Court calling this case political. Describing the atmosphere of Uttar Pradesh as filled with hatred towards him, he had demanded transfer of the case to Delhi. In July 2023, the Supreme Court issued a notice to the UP government and put an interim stay on the case.

Can be presented through video conferencing

On Tuesday, the Supreme Court bench of Justices MM Sundaresh and Arvind Kumar asked Somnath Bharti’s lawyer why he was demanding transfer of the case to Delhi. The lawyer said that there is no concrete fact against him in the case. The case was registered just to harass him. On this the judges said that whatever they have to say, they can put it in the court of Sultanpur. If there is a need to file a petition then it can be filed. After this the court rejected the petition of Somnath Bharti. However, the judges said that if Somnath applies for appearance through video conferencing, then the Sultanpur court should consider it.
