Can AI take away your job, why is the Chinese court’s decision being discussed?

AI Replacing Jobs: There has been a discussion going on around the world for a long time regarding Artificial Intelligence that in the future, machines will take away the jobs of humans. Big companies are rapidly adopting AI technology and in many places the work of humans is now being done by automatic systems. Meanwhile, the decision of a Chinese court has become a topic of discussion at the global level. This decision has clearly indicated for the first time that companies cannot easily fire employees just by citing AI.

In fact, a Chinese court has given its verdict in an important case, which has started a new debate regarding AI and employees’ rights. In such a situation, let us tell you today whether AI can really take away your job and why the decision of the Chinese court is being discussed.

What was the whole matter?

This matter is related to a company in Hangzhou city of China. Where a senior quality insurance supervisor worked. His monthly salary was about 25 thousand yuan i.e. about 3.4 lakh rupees. His job was to monitor the AI model. He ensured that the AI system understood the questions of the users correctly and did not forward any illegal or wrong information related to privacy. After some time the company made its AI system advanced. After this, the same system itself started doing many such tasks which earlier the employee used to handle.

In such a situation, instead of terminating the old role of the employee, the company offered him a new job with lower salary and smaller post. According to the report, his salary in the new post was reduced by about 40 percent. The employee did not accept this change, after which the company terminated his contract and offered compensation. The employee challenged this decision and the matter reached the court.

The court rejected the company’s argument

After the matter reached the court, in the Hangzhou Intermediate People’s Court of China, the company said that the working conditions had changed after the introduction of AI technology. Therefore, change in job was necessary, but the court did not completely accept this argument. The court said that adopting AI was the company’s own business decision. This cannot be seen as a natural disaster. According to the court, the work of the employees had not completely ended, but their role was changing. Responsibilities like monitoring the AI system, quality checking and following the rules were still necessary. The court also held that a huge cut in the salary of an employee and reduction in his rank cannot be called a fair change. The court has clearly said that during technological changes, employees should get respectable posts and fair salaries.

Why did the court’s decision increase discussion in the world?

This decision of the court is being considered a big step towards creating a balance between AI and employment. The court indicated that companies cannot put employees under pressure in the name of AI. Even if the role of an employee changes, it is important to treat him/her fairly. Many important questions were also raised in this matter like whether AI can be considered an illegal basis for termination of employment. Can companies reduce the salaries of employees in the name of technology and is it necessary to take care of the status and respect of the employees while sending them to a new role. The court made it clear that if the answers are not found then it could be illegal to fire the employees.
