Court’s decision for jailed student, police escort fee waived, now he can give exam

Mumbai News: A sessions court in Mumbai, while waiving the police escort fee for the accused in the Poxo Act case, said that the right to education is a fundamental right and no person can be deprived of it. The accused wanted to appear in his college examinations.

The accused is a 21-year-old student of Bachelor of Computer Application (BCA). The accused is facing a case under the POCSO Act for sexually assaulting a girl. He has been in judicial custody since January and is lodged in a jail in Thane district. Chittaranjan Kumar, the counsel for the accused, had filed an application to take the exam.

‘The accused’s father is paralyzed’

The application filed by Chittaranjan Kumar said that his client should be granted interim bail to appear for the examination which was to begin on May 20. He had said that either waive off the police escort fee which he would have to pay. The lawyer told that the accused’s father has paralysis due to which he is bedridden and the family cannot pay the escort fee.

Justice MM Taklikar’s remarks

Additional Sessions Court Judge SM Takalikar in an order passed on May 19 allowed the waiver of charges. Orders will be available in this week. The judge has given this decision after hearing the prayer of his father about being unable to pay the escort fees to the jail administration. The court said that the right to education is a fundamental right and it cannot be denied to any person, therefore it would be appropriate to allow the accused to come to the examination center without depositing the escort charge.
