Big reshuffle in NTA, know how the government can interfere in this and what is the legal position?


Amidst the ongoing controversies regarding NEET UG examination, the functioning of the National Examination Agency is once again in the news. Amidst the continuously raised questions, the Central Government has started the process of reforming the agency on a large scale. Many changes are being made from appointment to new posts to security, cyber security, investigation system and administrative structure. Besides, information about removal of 47 officers associated with NTA and legal action in some cases has also come to light.

Amidst all this, a big question is also arising that when NTA is an autonomous organization, then how can the government interfere in it, can the central government make changes directly and what is its legal status?

Why was there a need for change in NTA?

In the last two years, many questions were raised on the credibility of NTA. Bihar Police and later CBI investigation started in NEET UG 2024 paper leak case. The UGC NET exam had to be canceled due to fear of possible paper leak. Earlier, technical and operational glitches were also revealed in the initial edition of CUET UG. Recently, even after the leak of NEET UG paper 2026, questions are being raised continuously and protests are going on across the country regarding the paper leak. After these incidents, many questions are being raised on examination security, confidentiality of question papers, data security, monitoring of examination centers and administrative system of the agency. After this, the Central Government appointed former ISRO chief Prof. A high level expert committee has been formed under the chairmanship of Radhakrishnan, which recommended institutional reforms in NTA. Now the same recommendations are being implemented in a phased manner.

What changes are being made in NTA

For the first time, NTA has started the recruitment process for four senior level General Manager posts. The responsibility of these officers will not only be to conduct the examination, but will also be to make the entire examination system more secure, transparent and scientific. According to the report, NTA has terminated the services of 47 officers. Legal and criminal action can also be taken against some of these officers. The government says the move is part of a broader reform process to establish accountability in the agency. In the coming time, changes can also be made in the administrative state and outsourcing system.

How can the government interfere in NTA?

NTA is an autonomous body, but its operations are not completely separate from the government. The agency works under the Ministry of Education and the Central Government plays a major role in its administrative and policy decisions. NTA was formed in 2017 as an autonomous body under the Ministry of Education. It is registered under the Society Registration Act 1860 and comes under the purview of the Right to Information Act. The governing body of NTA is headed by the Secretary of the Department of Higher Education and approves the policies, administrative direction and major decisions of the agency. Therefore, if necessary, the Education Ministry can implement reforms in NTA. The number of permanent posts in NTA is also limited, many officers come from various government departments and institutions through deputation. In such a situation, the central government plays a big role in senior level appointments and administrative changes. Even after the recent controversies, the central government is reviewing the entire structure of the agency. Based on the recommendations of the expert committee, many changes are being made in outsourcing arrangements, examination conduct and so on.

Legal status of NTA

NTA is not a constitutional body, NTA has been created to conduct national level entrance examinations. It has been formed under the Ministry of Education and it works as a registered society. Therefore, the agency certainly has autonomy in its operations, but the central government continues to play a role in it at the policy and administrative institutional level. Therefore, if necessary, the government can reform, reorganize and make administrative changes in it.
