Delhi HC acquits accused in murder case, ‘faced the case despite no evidence’

Court News: The Delhi High Court on Monday (June 19) acquitted an accused in a 2004 murder case for lack of evidence after nearly 19 years. This person was accused of destroying evidence in a murder case. The court acquitted the man, saying, “This man faced trial for many years despite there being no incriminating evidence.”

According to news agency PTI, the High Court said that the prosecution initially did not find any incriminating evidence against the man and even he was not named in the FIR or the preliminary charge sheet. Justice Swarna Kanta Sharma allowed Vijay Bahadur’s appeal challenging the lower court’s 2011 verdict. In which he was convicted of criminal conspiracy and destruction of evidence and sentenced to one year in prison.

Man acquitted after 19 years in murder case

The Court observed that when the appellant and the other co-accused were acquitted of the main charge of murder and the trial court came to the conclusion that the prosecution had failed to establish the guilt of Bahadur and others for the murder, he was guilty of destruction of evidence. cannot be held.

What did the Delhi High Court say?

The High Court held that Vijay Bahadur could not be held independently guilty of destruction of evidence as the main offense under Section 302 (murder) of the IPC was not proved against any of the accused persons. Apart from this, there were discrepancies in the investigation and there was also a mistake in filing the supplementary charge sheet against the appellant on the oral instructions of the lower court.

The Court said that some unusual and interesting facts have emerged from the relevant judgment of the lower court and the most obvious one is that the supplementary charge sheet in the case against the appellant was filed on the oral instructions of the lower court.

What is the whole matter?

Significantly, in November 2004, a person lodged a complaint alleging that his driver went missing along with his car. The car was used for tourism. During investigation, the driver’s body was found and four people who had booked the taxi for the tour were arrested in 2004. Bahadur was arrested by the police in 2006.

The High Court, after considering the evidence placed on record, concluded that the evidence adduced by the prosecution was inherently insufficient to establish a solid basis for conviction. The Court observes that despite there being no incriminating evidence against the appellant, he has been convicted merely on the basis of a presumption. The appellant has faced trial for many years despite there being no evidence. The court acquits Vijay Bahadur of all charges.
