SC decision stirs up Maharashtra, Thackeray demands CM’s resignation, Shinde retaliates

Supreme Court Maharashtra Verdict: The Supreme Court on Thursday (May 11) refused to give relief to Uddhav Thackeray while giving its verdict in the case of disqualification of 16 Shiv Sena MLAs. The court has sent the matter to the bench of seven judges. Uddhav Thackeray demanded the resignation of Eknath Shinde and Devendra Fadnavis after this decision. While the leaders of the ruling coalition rejected this demand of Thackeray.

1. The Supreme Court on Thursday said it cannot restore the then Maha Vikas Aghadi (MVA) government headed by Uddhav Thackeray as he had resigned in June last year without facing the floor test. Since Thackeray had resigned without facing a trust vote, the Governor corrected him by inviting Shinde to form the government at the behest of the BJP, the largest party in the House.

2. The court also pulled up the then Governor of Maharashtra Bhagat Singh Koshyari and said that it was not proper for the Governor to call Uddhav Thackeray to prove his majority in the House. The governor did not have any such material on the basis of which he would have doubted the trust of the government. There was no indication in the resolution on which the Governor expressed confidence that the MLAs wanted to walk out of the MVA government. His decision was not according to the constitution.

3. In a unanimous verdict on several petitions related to the Maharashtra political crisis, a five-judge constitution bench said that the Speaker’s decision to appoint Shinde faction’s Bharat Gogawale as the Shiv Sena whip was illegal.

4. The court referred the 2016 Nabam Rebia judgment of a five-judge constitution bench dealing with the power of the Speaker to disqualify legislators to a larger seven-judge bench and asked the Speaker to decide disqualification petitions within a reasonable time. Needed.

Shiv Sena (Uddhav Balasaheb Thackeray) chief Uddhav Thackeray said after the court’s decision that the Chief Minister of Maharashtra Eknath Shinde And Deputy Chief Minister Devendra Fadnavis should resign on moral grounds and face further elections. He said that my resignation as Chief Minister could have been legally wrong, but I had resigned on moral grounds. How could I run the government with backstabbing people.

6. On the other hand, Chief Minister Shinde and Deputy Chief Minister Fadnavis jointly welcomed the decision. Eknath Shinde said that the government was formed within the legal and constitutional framework. Now the court has approved it. Earlier people used to get false happiness in calling our government an unconstitutional coalition. You (Uddhav Thackeray) had given your resignation. You had a minority, how many people were left? He knew that he would be defeated and then the Governor took the decision which was right.

7. Devendra Fadnavis said that talking about morality does not suit Uddhav Thackeray. Thackeray said he did not face the floor test on moral grounds. I want to know where was his morality when he fought the assembly elections with us in 2019 but joined hands with the opposition parties to form the government. He claimed that Uddhav Thackeray had resigned out of shame.

8. Fadnavis said that today the Supreme Court has ruined the plans of the Maha Vikas Aghadi. The conspiracy of Maha Vikas Aghadi has failed. The Supreme Court has accepted that the present government of Maharashtra is completely constitutional. Eknath Shinde celebrated the court’s decision with party workers outside his residence in Mumbai. Shiv Sena workers celebrated a lot after the court’s decision in Pune as well.

9. NCP chief Sharad Pawar said that BJP and morality are contradictory to each other. What more can I say. BJP’s strategy is that if it cannot win on its own, it breaks the smaller parties and forms the government. This is not good for democracy.

10. Congress MP Jairam Ramesh said that in today’s decision, the whip of the Shinde faction was considered illegal, the Speaker’s decision to recognize the Shinde faction as legal is also illegal and the decision taken by the Governor regarding the majority test in the assembly is completely illegal. What moral right is left with Shinde-Fadnavis to stay in power? Double engine government in Maharashtra is three times illegal.
