Sin or great sin: Do law and scriptures ever forgive those who steal temple money?

When an incident of theft comes to light in a temple, it does not make news just because some jewelery or money goes missing. Every thing related to the temple is a symbol of faith, belief and dedication of millions of people.

Therefore, from historical and religious point of view, theft of temple has been considered different from ordinary theft. The question arises whether such incidents happened in ancient India also, and if they happened, how did the justice system of that time deal with them?

Temples were not just places of worship, they were the largest public institutions of that era!

In ancient India, big temples were the centers of social, economic and cultural life at that time. They had agricultural land, gold and jewelery received from donations were kept safe, there were grain stores and many temples also did work related to education, medicine and public welfare.

Historian K.A. Nilakanta Sastri (KA Nilakanta Sastri) in ‘The Cholas’ has described the temples of the Chola period as the basis of the economic system of South India. According to Burton Stein, temples were an important link connecting local administration, economy and society. For this reason, temple property was not considered private property, but a public and sacred responsibility.

‘Devdravya’: Confluence of faith and law

In the religious scriptures, the word ‘Devdravya’ is used for the property of the temple. This meant not only the jewelery of the deity, but also everything like temple land, donations, grain, livestock and worship materials that had been dedicated to the deity. Once an object was offered to God, it no longer remained the personal property of any person. Therefore, its theft was considered not only an economic crime but also a serious violation of religious and social belief.

King’s responsibility and Kautilya’s Arthashastra

In ancient Indian political thought, the first duty of the king was to protect religion and public institutions. In Kautilya’s ‘Arthashastra’, special priority has been given to the security of temples. Scholar R.P. According to Kangle, the main objective of Kautilya’s penal policy was not to retaliate but to protect the public order of the state. There punishment was determined according to the nature and seriousness of the crime, which included financial fines, confiscation of property and other harsh measures.

The process of justice: from accusation to verdict

An interesting aspect of the ancient judicial system is its procedural alertness. Inscriptions and texts indicate that punishment was not given on the basis of mere accusation. The king or his appointed officials conducted a detailed investigation of the case, took statements from witnesses and reconciled the temple accounts. Even in texts like Manusmriti, the punishment was not uniform, it was multi-tiered depending on the stolen item, its value and social circumstances. The criminal confessing his crime before the king and atoning for it was also considered a part of the justice process.

Testimony of pages of history and inscriptions

This topic is not limited to religious scriptures only. The inscriptions of South India are living evidence of how transparently the accounts of temple property were maintained. In many Tamil inscriptions of the 15th century, a very strict attitude has been adopted towards those who embezzled temple income. Such criminals were called ‘Shivdrohi’ (traitors of Lord Shiva) and ‘Gurudrohi’. These words not only legally but also morally completely isolated the criminal from the society.

What is the lesson for today’s India?

The available texts, inscriptions and research of historians of ancient India agree on one thing, the temple property was not personal wealth, but ‘Devdravya’. Although the penal system changed in different periods, one thing remained the same, theft from the temple was considered an attack on the faith of the society.

The purpose of history is not to implement the same penal system in today’s times, but to understand how important transparency, accounting and accountability of faith-related institutions are in any society. Keeping records of temple property thousands of years ago and considering its misuse as a serious crime is an inspiration for efficient management of public institutions even today.
