BJP gave special advice for North East in the meeting of Parliamentary Committee on UCC, what did the opposition say?


Parliamentary Committee Meeting: BJP MP Sushil Kumar Modi, in a parliamentary committee meeting chaired by him, advocated keeping the tribals of North East and other regions out of its ambit in case of uniform civil code. At the same time, members of some opposition parties questioned the move of the Law Commission to start consultations on this controversial issue. Sources gave this information.

Department-related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Trust held an important meeting on Uniform Civil Code on Monday. Representatives of the Legal Affairs Department, the Legislative Department and the Law Commission of India were called in this.

Sources said that members of most of the opposition parties, including the Congress, DMK, have pushed for the Uniform Civil Code (UCC) Lok Sabha Elections linked to. At the same time, Shiv Sena MP Sanjay Raut said that many countries have uniform civil code and also asked to pay attention to the concerns of different regions and communities. Raut also raised questions about the timing of starting the process of consultation on this subject.

These MPs raised questions on the action of the Law Commission

Congress MP Vivek Tankha and DMK MP P Wilson submitted separate written statements questioning the Law Commission’s move to invite suggestions from people and other stakeholders on the UCC. The Law Commission was represented by its Member Secretary K Viswal in the meeting.

Tankha and Wilson said that they have seen the Law Commission’s discussion paper dated 31 August 2018 on the reform of family law and UCC has been described as neither necessary nor desirable at this stage. Congress MP and committee member Vivek Tankha in his tweet shared the letter written on July 3 to Sushil Kumar Modi, chairman of the parliamentary committee.

In the letter, Tankha said that after perusing the discussion paper dated August 31, 2018 on ‘Reforms in Family Law’, he is of the view that this discussion paper was notified for the consideration of all the parties and hence a draft is being prepared after obtaining public opinion. Reports should be prepared. He said that not only the views of the Law Commission came out in this report, but also the views of the people who would be affected by it.

Tankha said that in the said discussion paper it was said that while considering the issue of Uniform Civil Code, the Constitution of India should be considered as a whole and it should be kept in mind that bringing about uniformity would violate many provisions of the Constitution and especially But there would be a violation of the Sixth Schedule and Articles 37(a) to (i).

On the other hand, DMK MP and another member of the committee, P. Wilson, said in his tweet, “Today, before the meeting of the Parliamentary Committee on Law and Justice, I asked the chairman of the committee, Sushil Modi, to conduct a public consultation before the Law Commission on Uniform Civil Code.” Handed over the letter to do.

He said that he was surprised that when the 21st Law Commission, headed by a retired Supreme Court judge, had conducted a detailed study and concluded in 2018 that UCC was not desirable, the present Law Commission is re-examining the issue. Insisting on opening up and further discussions.

Wilson asked if he wanted to undermine the discussion paper of the 21st Law Commission? Meanwhile, sources said that Manickam Tagore of the Congress linked it to the upcoming elections, questioning the intention of the move.

Mahesh Jethmalani advocated for UCC

BJP’s Mahesh Jethmalani, however, strongly advocated the UCC and cited the discussion on this subject in the Constituent Assembly. Sources said Sushil Modi, head of the parliamentary committee on law, pitched for keeping tribals from the Northeast and other regions out of the purview of any proposed Uniform Civil Code. Sources said that it was pointed out in the committee meeting that central laws are not applicable in some northeastern states without their consent.

He told that 17 members of the 31-member committee were present in the meeting. Law Commission officials said that since June 13, 19 lakh suggestions have been received during the consultations. This exercise will continue till July 13.

Significantly, the Uniform Civil Code has been one of the three major election issues of the BJP for a long time. Prime Minister Narendra Modi had recently strongly advocated Uniform Civil Code (UCC) in Bhopal and asked, “How will the country run with a dual system?” He had said that Muslims are being instigated on this sensitive issue.

Opposition parties targeted Prime Minister Narendra Modi for his remarks related to the Uniform Civil Code and accused him of trying to divert attention from the real issues like inflation and unemployment. AIMIM’s Asaduddin Owaisi had asked whether the country’s pluralism will be taken away in the name of UCC?
