Karnataka HC On KGF Copyright Case: The Karnataka High Court has refused to quash the FIR filed against Congress leaders Rahul Gandhi, Jairam Ramesh and Supriya Shrinate for alleged copyright infringement of the music of the hit film ‘KGF Chapter-2’. Justice M. Nagaprasanna gave this verdict on Wednesday (June 29) while dismissing the petition filed by three Congress leaders.
The complaint regarding copyright infringement was filed by M. Naveen Kumar of MRT Music, a subsidiary of Lahari Music, at Yeshwanthpur police station in Bengaluru. It said that the Congress party used the music of the film in a promotional video of ‘Bharat Jodo Yatra’, while it is copyrighted by them.

The Single Bench, while dismissing the petition, said in its order, “It appears that the petitioners have tampered with the ‘source code’ without permission, which would undoubtedly be infringing the copyright of the company.” It seems that the petitioners have taken the copyright of the company lightly. Therefore, prima facie all these should be rejected as evidence in the investigation.
This FIR is under Indian Penal Code (IPC) section-34 (criminal act with common intention) read with section 120-B (criminal conspiracy), section- 403 (dishonest misappropriation of property), section 465 (forgery), and copyright The FIR was registered under section 33 of the Act and section 66 of the Information Technology Act.
Argument given by Congress leaders
On this, the court was argued by the Congress leaders that the matter was related to copyright infringement, but a criminal complaint was filed and the police immediately registered an FIR. Advocate AS Ponanna, appearing for the Congress leaders, argued, ‘Copyright is a statutory right. In the absence of the nature of cognizable offence, (this) FIR is bad in law.’
A case was filed in the commercial court, after which the social media account of the Congress party was ordered to be “freezed” but after the Congress gave an undertaking to remove the video in question from the social media. Later, the High Court rejected the order related to “freezing” the account.
