Struggle on Uniform Civil Code, Uttarakhand government prepared UCC draft, what are the provisions?

Uniform Civil Code: Discussion on Uniform Civil Code i.e. UCC has started across the country. Actually, the Law Commission has sought opinion on this from common people and religious organizations. Meanwhile, the BJP government of Uttarakhand is going to present the draft of UCC in the Vidhansabha on 30th June. After this, questions are arising as to what provisions have been made in the UCC to be implemented in Uttarakhand.

The Uttarakhand government had formed an expert committee in March 2022 to prepare a uniform civil code. Regarding UCC, the Dhami government had sought feedback and suggestions from the common people. After this, about 2 lakh 31 thousand suggestions were sent to the committee. With these suggestions, the draft UCC was prepared.

What did the committee say?
A program was organized to know the opinion of the people of Uttarakhand living in Delhi on the UCC of Uttarakhand. Former Supreme Court judge Ranjana Prakash Desai, who is leading the expert committee formed by Dhami government to prepare the draft of UCC, also participated in this programme. During this, he said that UCC will strengthen the social fabric. Along with this, it will also be helpful in fighting economic, social and religious discrimination.

What suggestions have been received?
The committee to prepare the draft of UCC was asked to increase the age of marriage of girls so that they get a chance to graduate. In addition to not giving government facilities in case of non-registration of marriage and giving equal rights of divorce to both the husband and wife, the suggestions have also talked about a complete ban on polygamy.

Along with giving equal share to boys in succession to the girls, if the wife dies and her parents have no support then the husband will be responsible for her maintenance. Apart from this, Muslim women will also get the right to adopt. The adoption process will be simplified. Halala and Iddat will be banned. Declaration of live in relationship will be necessary. It will be like a self-declaration which will have a statutory format.

In case of orphanhood of the child, to ease the process of guardianship and in case of quarrel between husband and wife, the custody of children can be given to their grandparents.

The Congress, the TMC and the All India Muslim Personal Law Board hit out at the government after the Law Commission on Wednesday (June 14) sought views and suggestions from various stakeholders, including people and members of recognized religious organizations, on the UCC. At the same time, Nationalist Congress Party (NCP) Chief Sharad Pawar said that there is a need for a population control law. JDU said that everyone needs to be taken into confidence.

What did the All India Muslim Personal Law Board say?
The All India Muslim Personal Law Board said that the country does not need the UCC. Board spokesperson SQR Ilyas said, “In 2016, the same Law Commission had said that UCC should not be discussed for 10 years. In such a situation, why did the Law Commission change its stand? BJP wants to use it as an issue in the upcoming Lok Sabha elections. When it comes to UCC, the country does not need it.

What did Sharad Pawar say
There is a need for a population control law for all citizens irrespective of caste and religion but it needs to be known whether the UCC is targeted at a particular community and then we can speak (on that).

What is Congress saying?
The Congress on Thursday (June 15) alleged that the Law Commission’s new move on the Uniform Civil Code shows that the Modi government wants to divert attention from its failures and legally legitimize its polarizing agenda.

Congress General Secretary Jairam Ramesh said that the Law Commission should take care of its legacy and also remember that the interests of the country are different from the political ambitions of the BJP.

JDU asked to talk to whom?
Bihar Chief Minister Nitish Kumar, while stressing the need to try to reach a consensus on the issue of JDU UCC, said on Thursday that all parties should be taken into confidence.

Party spokesperson KC Tyagi cited a letter sent by CM Nitish Kumar to the then Law Commission chairman BS Chauhan in 2017, in which Kumar had said that the UCC should be seen as a reform measure for public welfare, not As a political measure which is imposed on the people without their will without consultation.

TMC links UCC to 2024
West Bengal Chief Minister TMC while targeting the central government regarding UCC said that it is fueling divisive politics due to frustration. Party spokesperson and Rajya Sabha member Derek O’Brien tweeted that the government has failed to fulfill its promise to control inflation and create new jobs.

Brian said, “When you can’t provide employment. When you can’t control inflation. When you disturb the social fabric. When you fail to deliver on any of the promises made, you can fan the flames with deep divisiveness before 2024 in your frustration.
