The Supreme Court on Monday (July 13) has stayed the order of Madras High Court imposing a complete ban on cow slaughter in Tamil Nadu. The state government had approached the Supreme Court against this order. Citing state rules, he had said that there is no legal ban on killing of cows above 10 years of age. The High Court has gone beyond this and issued an order.
According to the report of ‘Bar and Bench’, the bench of Justice Vikram Nath and Justice Sandeep Mehta, while hearing the appeal of Tamil Nadu government, issued notice on the petition of the state government and ordered to stay the effect of the High Court’s decision till the next hearing.
What argument did the Tamil Nadu government give in the Supreme Court?
The Tamil Nadu government had argued in the Supreme Court that the original petition was limited only to the issue of alleged sacrifice of cows and calves outside legal slaughterhouses on the occasion of Bakrid. The government said that the division bench of the Madras High Court, moving ahead with this issue, directed for a complete ban on the slaughter of cows in the entire state, which is beyond the scope of the petition and is not in accordance with the law.
It is noteworthy that the Madras High Court, in its order given on May 27, citing Article 48 of the Constitution and the order regarding prohibition of cow slaughter issued by the Tamil Nadu government in 1976, had directed the state government not to allow slaughter of cows and calves on any day including Bakrid.
After the latest order of the Supreme Court, the High Court’s instructions will no longer be effective. In the next hearing of the case, the Supreme Court will decide whether the order of the Madras High Court was in accordance with the law and the Constitution or not.
