Interim government will be sworn in tomorrow in Bangladesh! There is no provision in the constitution, the path is full of challenges

Bangladesh Crisis News: Bangladesh is set to form a new interim government under the leadership of Nobel Peace Prize winner Muhammad Yunus. The country’s army chief said on Wednesday (August 7) that the interim government will be sworn in on Thursday (August 8). 84-year-old economist Muhammad Yunus has been given the command of the head of the interim government by President Mohammad Shahabuddin.

After massive protests in Bangladesh, the interim government will now be run by Nobel Peace Prize winner Muhammad Yunus. Speaking to the media in Paris, Muhammad Yunus said, “I am eager to go back home and see the situation there closely. We have to see how we will be able to organize the country amidst the crisis Bangladesh is going through.”

What does the Constitution say about the interim government?

According to the Hindustan Times report, the current constitution of Bangladesh does not include any provision for an interim government. However, Bangladesh earlier had a provision which mentioned a caretaker government. According to the Dhaka Tribune, the 13th amendment was passed in the Constitution of Bangladesh in 1996 which included provisions for a caretaker government to conduct fair general elections and transfer of power.

What is in the new amendment to the Constitution?

According to reports, non-party caretaker government has been added in the new amendment to the Constitution of Bangladesh. After the new amendment, non-party caretaker government has been defined in Chapter IIA in Part IV of the Constitution. New articles 58A, 58B, 58C, 58D and 58E have also been included.

Let us tell you that these new articles explain the appointment and tenure of the Chief Advisor and other advisors in the caretaker government. The important thing is that this system of the Constitution was used to oversee three elections. After this, the Supreme Court declared the caretaker government system unconstitutional. After the decision of the Supreme Court, on June 30, 2011, the Awami League government abolished it through constitutional amendment.

The caretaker government was terminated

After the decision of the Supreme Court and the decision of the government, it was decided to formally end the caretaker government in Bangladesh on 13 September 2012. According to the current constitution, the government in power conducts elections at the end of its term in Bangladesh and power is handed over to the winning party.

The challenges are not less

A new interim government will rule Bangladesh under the leadership of Nobel Peace Prize winner Muhammad Yunus. However, the Constitution of Bangladesh does not guide the caretaker government. In this situation, the formation of an interim government has become a legal dilemma. It will be interesting to see how Muhammad Yunus faces this legal dilemma.
